Pursuant to NRS 116.760 persons who are aggrieved by a violation of Chapter 116 of the Nevada Revised Statutes or the Nevada Administrative Code may file an Intervention Affidavit with the Nevada Real Estate Division (NRED). The affidavit is referred to the Ombudsman for attempted resolution between the parties though the Ombudsman’s guidance and if a resolution is not reached the affidavit is turned back over to the Division along with a report from the Ombudsman. The Division then begins an investigation into the complaint, which may lead to the filing of a Formal Complaint with the Commission and the scheduling of a hearing.
It is important to protect the rights of associations and board members throughout the NRED Complaint process. A failure to preserve the rights of the association and its board may lead to unnecessary fines, costly corrective orders, the inappropriate disclosure of confidential information, and unforeseen civil liability for the association, its members, and association management. Fuller Jenkins attorneys safeguard the rights of associations and board members by handling the NRED Complaint process from beginning to end.
