The decision to get a divorce (referred to as a "dissolution" in the California judicial system) is one of the most difficult decisions a person may have to make. The areas to be addressed in a dissolution will vary from case to case depending on the length of the marriage, whether or not children are involved and the size of the marital estate. It is vital that at the beginning of the process, when you are considering whether or not to undertake the process, that you consult with an experienced family law attorney who can counsel you about the process and explain what you should expect in a divorce. Dissolutions are serious matters, not to be undertaken without serious thought and contemplation. The standard of living you enjoyed prior to filing for divorce is almost never realized once the process is finalized. In addition to the grief and emotional strain you will experience if you divorce, the effect of a dissolution on children and extended family members also can be substantial. At your initial visit with a lawyer from Fuller Jenkins, the process will be explained to you so that you can make an informed decision as to whether or not dissolution is the right option for you.

If you decide to proceed with a dissolution, you will need to have a strategy for how you want your case to proceed. Do you know the full extent of the assets and debts in your marital estate? If so, do you want to engage in early settlement discussions? If not, what types of inquiries need to be made to determine the full extent of the assets and debts in the estate? Do you plan to remain in the area where you lived prior to filing for divorce? Can you agree with your spouse on a custody and visitation plan that is in the best interests of your children? How would you like your assets divided? Is there agreement between you and your spouse as to what property you will take and what property they will take? These questions and many others will need to be discussed with your attorney at the outset of litigation so that a plan can be formulated to carry you through all phases of the divorce process. Once a litigation strategy is in place, the dissolution process can begin.
